This privacy notice applies to visitors to our website (https://www.scran.ac.uk) "Website", contributors to our Website, or individuals who purchase subscriptions, digital image(s) or products from us through our Website.

 We are Historic Environment Scotland, an executive non-departmental public body, incorporated and established under the Historic Environment Scotland Act 2014, being a registered charity (Scottish Charity number SC045925) and having its principal office at Longmore House, Salisbury Place, Edinburgh, EH9 1SH.

We are a data controller for the purposes of the General Data Protection Regulation (Regulation (EU) 2016/679) and related data protection legislation.

3. Privacy notice

  1. We are committed to protecting your personal data and your privacy. This privacy notice sets out the basis on which any personal data we collect from you, or that you provide to us, or that we acquire from a third party, will be processed by us. Please read the following carefully to understand our practices regarding your personal data and how we will treat it.
  2. Before we process your personal data, we are obliged to inform you of who we are, why we need to process your personal data, what we will do with your personal data and to whom we will pass your personal data.
  3. The data protection law in the UK will change on 25 May 2018. Although this privacy notice sets out most of your rights under the new laws, we may not yet be able to respond to some of your requests (for example, a request for the transfer of your personal data) until May 2018 as we are still working towards getting our systems ready for some of these changes.
  4. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

4. The data we collect about you

  1.  Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity of the individual has been removed (anonymous data).
  2. We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
    1. Identity Data includes first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.
    2. Contact Data includes billing address, delivery address, email address and telephone numbers.
    3. Financial Data includes bank account and payment card details.
    4. Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
    5. Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access the Website.
    6. Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
    7. Usage Data includes information about how you use our Website.
    8. Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
  3. We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

5. If you fail to provide personal data

 Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with your tickets). In this case, we may have to cancel the contract you have with us but we will notify you if this is the case at the time.

6. How is your personal data collected?

We use different methods to collect data from and about you including through:

    1. Direct interactions. You may give us your personal data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:
      1. create an account on our Website;
      2. fill in forms on our Website;
      3. request marketing to be sent to you;
      4. enter a competition, promotion or survey; or
      5. give us some feedback.
    2. Automated technologies or interactions. As you interact with our Website, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, and other similar technologies.
    3. Third parties or publicly available sources. We may receive personal data about you from various third parties and public sources as set out below:
      1. Contact, Financial and Transaction Data from providers of technical, payment and delivery services; or
      2. Identity and Contact Data from publicly availably sources such as Companies House and the Electoral Register based inside the EU.

7. How we use your personal data

 We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

    1. Where we need to perform the contract we are about to enter into or have entered into with you.
    2.  Where it is necessary:
      1. for us to carry out a specific task in the public interest which is laid down by law; or
      2. for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
      3. Where we need to comply with a legal or regulatory obligation.
    3. Generally we do not rely on consent as a legal basis for processing your personal data other than in relation to sending direct marketing communications to you via email or text message.

10. How long do we retain your data?

 We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. 

 To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

11. Marketing

 We will only use your personal data for direct marketing purposes where you have consented to be contacted for such purposes. We do not share your personal details with any third party for their marketing purposes. You have the right to withdraw consent to marketing at any time by contacting us using the details above.

    When we process your personal data for the above purposes, we do so on the basis that such processing is necessary for compliance with a legal obligation to which we are subject or necessary in order to protect the vital interests of a natural person, respectively or necessary in order to pursue our legitimate interests in exercising our legal rights.

  3. Corporate governance

 We may share your personal data with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

When we process your personal data for the above purpose, we do so on the basis that we have a legitimate interest in pursuing business aims and objectives.

 We do not transfer personal data outside of the European Economic Area.

15. Data Security 

  1.  We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
  2. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

16. Your rights 

 Your personal data is protected by legal rights, which include your rights:

  1. Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  2. Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  3. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  4. Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. 
  5. Request restriction of processing of your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

Security Policy

Scran's site is secured by a hardware Firewall. Your information is stored in a database behind this to ensure confidentiality. The database system is password protected and only staff associated with the processing of your information may access the system.

In the shop, customer's purchase details are processed directly by the Royal Bank of Scotland WorldPay System using an SSL+ (Secure Socket Layer) Level 3 system and TLS (Transport Layer Security).

Scran does not store any details about your credit or debit cards ever.
